1. Acceptance of Terms
By accessing or using the SwiftLink Logistics, LLC ("SwiftLink," "we," "us," or "our") website and services, you agree to be bound by these Terms & Conditions. If you do not agree, do not use our website or services.
2. Services
SwiftLink Logistics is a third-party logistics (3PL) freight brokerage that arranges the transportation of goods between shippers and carriers. We do not own or operate trucks. All transportation is performed by independent, licensed motor carriers. Quotes provided are estimates and may vary based on shipment details, market conditions, and carrier availability.
3. User Responsibilities
You agree to provide accurate and complete information when submitting quote requests, booking shipments, or communicating with our team. You are responsible for ensuring that shipments comply with all applicable federal, state, and local laws, including hazardous materials regulations where applicable.
4. Quotes & Pricing
All quotes are non-binding estimates unless a formal rate confirmation or contract has been executed. Pricing is subject to change based on fuel surcharges, accessorial charges, weight discrepancies, or other factors. Final charges will be reflected on the invoice or bill of lading.
5. Limitation of Liability
SwiftLink Logistics acts solely as a broker and is not liable for loss, damage, or delay of cargo during transit. Carrier liability is governed by the carrier's tariff and applicable law. SwiftLink's total liability for any claim shall not exceed the brokerage fees collected for the specific shipment in question.
6. Claims
Cargo claims must be submitted in writing within nine (9) months of the delivery date. SwiftLink will assist in facilitating claims with the responsible carrier but is not the insurer of the cargo.
7. Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of SwiftLink Logistics, LLC and is protected by U.S. copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
8. Indemnification
You agree to indemnify and hold harmless SwiftLink Logistics, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or your violation of these Terms.
9. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Oakland County, Michigan.
10. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes acceptance of the revised Terms.
